The United States Citizenship and Immigration Services (USCIS)
announced that it is implementing a new filing system
specifically for Form I-129 (nonimmigrant employment-based
cases) and Form I-140 (permanent resident employment-based
cases). Namely, effective April 1, 2006, all nonimmigrant visa
petitions filed on Form I-129 are to be filed at the USCIS'
Vermont Service Center and all Form I-140 immigrant visa
petitions are to be filed at the Nebraska Service Center.
The USCIS is creating a "bi-specialization" system whereby
the four Service Centers will be "paired" to handle certain
types of cases. The Vermont Service Center and the California
Service Center will be responsible for adjudicating nonimmigrant
employment based cases and their related applications
(accompanying family members in dependent status), while the
Nebraska Service Center and the Texas Service Center will be
similarly paired to handle the adjudication of immigrant visa
petitions and their related applications.
The recent transfer of pending I-140 petitions from the
California Service Center to the Texas Service Center is related
to the change in bi-specialization.
