DOL rolls back PERM processing dates

The US Department of Labor (DOL) reports that as of February 28, 2010, it was processing PERM applications with initial filing dates of June 2009. DOL has revised the published processing dates, and now reports that as of January 31, 2010, the agency is processing PERM applications with initial filing dates of April 2009. It is unclear why DOL has revised the published processing dates.

Since early February, Jackson & Hertogs has received PERM certifications and audit notices for applications filed between April 2009 and August 2009. DOL has stated on numerous occasions that it processes PERM cases in first-in, first-out (aka FIFO) order. The recent variation in processing times would suggest that rather than working on PERM cases from a single month, DOL is working on PERM cases from several months at the same time. Jackson & Hertogs is monitoring the status of our pending PERM cases closely, and we will update clients as we obtain information regarding DOL processing.
