USCIS filing fee increase to be published tomorrow

The USCIS will publish a final rule in tomorrow’s Federal Register that will raise filing fees on almost all application and petition form types other than the N-400 for Naturalization. The new fees will be effective 60 days from the date of publication. Applications or petitions mailed, postmarked, or otherwise filed on or after November 23, 2010 must include the new fee.

The filing fees will be increased by a weighted average of 10 percent. The premium processing fee will be adjusted by the percentage increase in inflation published by the Consumer Price Index increasing to $1225 from the previous $1000. Some fees will also be reduced including the I-539 from $300 to $290 and the I-129F petition for alien fiancé from $455 to $340. Three new fees covering USCIS costs related to processing the Regional Center Designation under the Immigrant Investor Pilot Program, Civil Surgeon Designation, and DHS Processing of Immigrant Visa requests will be implemented.

Update 09/27/2010: USCIS did not originally list the updated fee for I-485 applicants under the age of 14. The new fee for children under the age of 14 will be $635 when:
(i) The child's I-485 application is submitted concurrently for adjudication with the Form I–485 of a parent;
(ii) The applicant is seeking to adjust status as a derivative of his or her parent;
and
(iii) The child’s application is based on a relationship to the same individual who is the basis for the child’s parent's adjustment of status, or under the same legal authority as the parent.
