H-4 and L-2 Processing Time Update
On January 19, 2023, DHS reached a settlement in Edakunni v. Mayorkas. According to the settlement:
• Effective January 25, 2023, H-4 and L-2 dependents who file I-539 and/or I-765 forms concurrently with their principal’s I-129 will enjoy bundled adjudication with the underlying I-129.
• USCIS will bundle adjudication where these filings are properly filed together.
• Bundled adjudication applies to filings with either premium processing or regular processing.
The terms of the settlement agreement are valid for two years.
