On April 22, 2020, President Trump issued a Proclamation suspending the entry of individuals seeking admission to the United States as immigrants. It is effective as of April 23, 2020 at 11:59 p.m. eastern daylight time for an initial 60 days with the possibility of extension. The order appears to only apply to individuals who are currently outside the United States as immigrants—without a valid immigrant visa—as of the date of this proclamation. It does not apply to individuals seeking entry as nonimmigrants (e.g., H-1B, L-1, F-1), to those who are already lawful permanent residents, or to those currently immigrating through “adjustment of status” procedures. The order also carves out certain exceptions, including for spouses of U.S. citizens, and applicants for EB-5 Investor Visas.
However the order contains the following caveat:
Within 30 days of the effective date of this proclamation, the Secretary of Labor and the Secretary of Homeland Security, in consultation with the Secretary of State, shall review nonimmigrant programs and shall recommend to me other measures appropriate to stimulate the United States economy and ensure the prioritization, hiring, and employment of United States workers.
