Proposed changes to certain filing fees and premium processing wait times

USCIS issued a proposal to increase filing fees for certain immigration processes and increase Premium Processing wait times. Several key proposals are as follows:

  • Different filing fees for different I-129 nonimmigrant filings. For example:

  • H-1B Cap registration increase:

  • Different filing fees for I-765’s filed online vs paper filings. Importantly, note USCIS’s lower proposed fee for submissions online (which may be one indication of positive trending towards technological advancements at the Agency):

  • Premium Processing wait times would be counted against business days (as opposed to calendar days).

These proposals are not yet in effect. USCIS is undergoing a 60-day public comment period. After which, they will report a final rule to congress, which will extend rule adoption by at least 60 additional days. For more information see:
