The Trump Administration announced that it will be issuing new regulations that will change the H-1B visa petition category significantly in regards to defining specialty occupations and prevailing wage. The Department of Labor (DOL) issued a regulation today which will be effective when it is published in the Federal Register on October 8, 2020. The regulation will change the computation of prevailing wages so that prevailing wages will be higher.
A regulation will also be published in the Federal Register by the Department of Homeland Security (DHS) on October 8, 2020. This regulation will take affect on December 7, 2020. Among other things this rule will narrow the definition of “specialty occupation”.
