Update regarding premium processing fees increase

Starting October 19, 2020, the USCIS will increase “premium processing” fees from $1440 to $2500 for all case types for which premium processing is currently available. This applies to any H-1B, L-1, or TN nonimmigrant visa petitions filed at a USCIS service center, and PERM-based I-140 immigrant visa petitions.

USCIS has issued no guidance on any of the other changes included in the September 30, 2020, “Continuing Appropriations Act, 2021 and Other Extensions Act” (HR 8337). The Act funded the U.S. government through December 11, 2020, but included a problematic section entitled “Emergency Stopgap USCIS Stabilization Act,” which outlined this premium processing fee increase, expanded premium processing availability for other visa categories, and processing timeline changes. Other than the fee increase effective October 19, 2020, no other changes have taken effect, as USCIS must properly implement any changes pursuant to federal law.  You can read about other upcoming changes to premium processing here.
