On February 2, 2017, U.S. Citizenship and Immigration (USCIS) issued a memorandum confirming that regardless of the nationality of the individual, the Executive Order does not affect applications and petitions filed:
- On behalf of individuals who are already in the United States;
- By landed permanent residents made either inside or outside the U.S.;
- For or by individuals outside of the U.S. as long as the approval does not directly grant travel authorization.
Further, USCIS confirmed that it will continue to adjudicate Form I-485 adjustment of status applications regardless of the nationality of the applicant.
