The U.S. Department of Labor (“DOL”) permanent labor certification application “special handling” regulations allow for a more streamlined process for universities filing for scholars who engage in classroom teaching. The process is more streamlined, in that a national journal ad is the minimum required recruitment. Universities must establish that the scholar was more qualified than any of the U.S. workers who were available and willing to take the position, and the application must be submitted within 18 months of the scholar’s selection. It is possible to re-recruit for the position as an alternative to pursuing the standard PERM labor certification process.
