On August 14, 2020, USCIS begun notifying our office of a second round of Fiscal Year (FY) 2021 H-1B cap registration selections. This second round of selections comes as a result of USCIS not receiving enough H-1B petition submissions from the H-1B cap registrations initially selected at the end of March 2020. The second round of selections are being chosen from the registrations submitted in March 2020 that were previously waitlisted. Those selected in this second round have a new 90 day window to submit a full H-1B cap subject petition to USCIS.
Any submitted FY2021 H-1B cap registrations which are not selected will remain as such until USCIS determines that enough petitions have been received to meet the Congressionally mandated cap of 85,000 for the 2021 fiscal year. Employers do not need to take any additional steps to ensure that any registrations which were not selected in March 2020 are considered for the current second round of selections.
